Terms and Conditions:

1. Scope and completion of the contract

1.1. The following Terms and Conditions (T&C) of Chili Entertainment, GmbH, Am Eisernen Schlag 46, 60431 Frankfurt am Main, Germany (in the following "operator") are valid for the web-portal GamePN (e.g. reached via http://www.GamePN.com).

1.2. GamePN is free of charge. In case of paid premium features or contents the operator and the user conclude a seperate agreement. 1.3.The contract between the user and the operator of GamePN is concluded, when the user registers with the necessary user data on the sign up page (email address, personal password). The user must be 18 years of age or older to use GamePN or must have a valid permission of his legal representative. Minors guarantee with their registration to GamePN that this permission of their legal representative is existent.

1.4. After registration the user gets a confirmation email to his email address in which an activation link is included for validating his account. Therefore, the user has to make sure, that the email address is valid for otherwise the operator is not able to help during registration or can establish contact with the user.

1.5. Users have the right to withdraw the contract within two weeks after registration (also see special instructions at point 11).

2. Benefits and services

2.1. GamePN is an internet platform giving users the opportunity to contact, to search for, to get to know other users and to publish content (texts, pictures and others) in the internet. The service does not include arranging contacts between users or guarantee them. GamePN is only a service platform on which users can communicate with each other using the offered search-, contact- and message-system.

2.2. GamePN cannot guarantee that during the contract duration contacts between users are established in the way the users intended.

2.3. GamePN is under constant development. The user has no right to claim realisation or the maintaining of a certain state.

3. Duration and cancellation

This contract may be terminated by the user or the operator at any time. The operator will delete all profile data and personal blogs out of the system and connected databases (also see separate notice in “privacy of information”). Personal messages to other users, comments and contributions in the message boards will not be deleted by the operator.

4. User contents and code of conduct

4.1. For all user-driven contents (e.g. pictures, personal information, texts) published on GamePN the respective users are responsible by themselves. Therefore the operator assumes no warranty for the correctness and legality of these user-driven contents. The user know, that all the provided, produced, entered or published data are accessible for all users of the internet. Each user takes this into account with the registration on GamePN. GamePN offers a notification function, users can use to report dubious content. In any case, users can also write an email to "support@GamePN.com" to report a dubious content.

4.2. Every user agrees to keep private and personal emails, messages and other data (names, telephone- and fax-numbers, postal addresses, email addresses, URLs, etc.) which he obtains from other users by using GamePN confidential and will not make them accessible to third parties or persons without the permission of the author of the information.

4.3. It is prohibited to abuse the platform GamePN to spread illegal and condemnable contents. Especially, it is prohibited to

4.3.1. spread violent illustrations and other violent presentations, pornographic contents, insults or discriminating illustrations or presentations in spite of race, gender, religion, nationality, physical handicaps or sexual tendencies of other users or other contents violating applicable law;

4.3.2. threaten and molest other users or impinging upon other users’ rights (including personal rights) or promising money or non-cash benefits for contacts or letting yourself promise such benefits;

4.3.3. upload data and files, which inherrit a virus or the software or different material, which is protected by copyright or patents or other rights (e.g. personal rights, trademark rights, industrial property rights, etc.);

4.3.4. use the platform in a way, which influences the operational availability of GamePN for other users in a negative way;

4.3.5. send emails and messages to other users for different reasons than private or personal communication, like advertisements or promtotion of services and products;

4.3.6. send or post spam/advertisements;

4.3.7. register on GamePN in the name of another person (fake profiles).

4.4. Further more, it is not permitted for users to falsify, dublicate, spread, send, publish or privatly use the data and information published by other users. These only serve as information during the use of GamePN.

5. Release from liability

5.1. The user affirms, that contens (e.g. texts, pictures, photos, films and sounds, etc.) which he transfers, are free of any rights of third persons or parties, which could oppose a publication or other use on GamePN. Users agree with the upload or imput of data that the uploaded data is published on GamePN.

5.2. The user indemnifies the operator and its employees from all claims of third parties or persons, who lodge a claim because of imputable infringements of the user, especially in the case of an infringements of the trademark legislation, design protection law, utility patent and patent rights, personal rights, copyrights and intangible goods rights.

5.3. Users account for the usual legal expenses and costs of prosecution of the operator and its employees, in case of infringements caused by the user.

6. Supervision of data

6.1. The user is sole responsible for the legal safety of his provided contents and communicational contributions.

6.2. The operator does not check the data published and provided by users (e.g. texts, pictures, graphics, hyperlinks, etc.) for the legal correctness (German law and T&C). Should the operator notice imfringements he will delete the corresponding data or contens after dutiful judgement and/or ban access to these data and/or ban the account of the user who provided the data or contents.

6.3. If users communicate on GamePN, there is no supervision of contents on the part of the operator, because these are treated as private and confidential. In case a user is offended by another user’s message and reports it, the operator reserves the right to check the communication between the respective users.

7. Ban, cancellaction and compensation

Regardless of other civil law and/or penal consequneces for the respective user a non-observerance of a duty regulated by these "Terms & Conditions" or the law, the operator is entitled to immediately ban the account of the respective user on GamePN and/or to cancel the contract between the operator and the user and/or assert the resulted damages.

8. Warranty

8.1. The operator does not guarantee the functionality of the communication platform and cannot be taken into account for the correctness, usefulness, reliability, timeliness or accuracy of the published information on GamePN.

8.2. If the service benefits of GamePN have substancial deficiencies, users can cancel the contract and claim their legal rights, if the user has given the operator notice about these deficiencies by email and an adequate timeframe to correct the deficiencies.

8.3. The user loses possible rights because of deficient service benefits, if he does not inform the operator about obvious deficiencies by four weeks after the conclusion of the contract via notice by fax, mail or email and in this notice – for reconstruction reasons - identifies the deficiencies and the exact date and time he discovers the deficient service benefit.

8.4. The operator has only to compensate the user’s damage under the circumstances stated at point 9.

9. Liability

9.1. The operator assumes no liability for damages that occur to users using the plattform GamePN. This is especially the case,

- if the platform is limited or destroyed by Acts of God, strike, lockout, system malfunctions or other damnifications or structures from outside or other parties;

- if third persons attain knowledge of personal data of users (eg. by hacking into the database or other unautorized actions);

- if information, which is given by the users themselves to third persons is abused by these third persons;

- if other users or unautorized users or hackers publish or send negative or illegal materials or contents and users get confronted with these;

- if a commercial provider is abusing GamePN.

9.2. This disclaimer is not valid in case of intent or gross negligence, in case of negligent breach of substantial contractual obligations and in case of culpable harm of life, body and health.

10. Applicable law and place of fulfilment

10.1. On legal matters concerning the contract between the user and the operator German law is applicable.

10.2. Place of fulfilment is Frankfurt am Main, Germany.

11. Special instructions on the right of withdrawal

11.1. The user can withdraw this contract within two weeks after registration without declaration of reasons. This need to be done in text form (eg. mail, fax, Email). To fit this two week period it is only necessary to send the withdrawal in during this time to: Chili Entertainment GmbH,Am Eisernen Schlag 46, 60431 Frankfurt am Main, Germany, or via email to support@GamePN.com.

11.2. In the case of an effective withdrawal all received benefits are to be refunded on both sides and returned if applicable. If the user is not able to refund the received benefits totally or partially, he has to pay compensation for the value of the benefits if applicable.

11.3. The right of withdrawal expires ahead of time, if the operator starts his services earlier than the two week period in case the user gives his explicit agreement or the user has by himself started the services (e.g. using the services).
